1. This addendum to document FCCC/SB/1999/MISC.10 contains two additional proposals on principles, modalities, rules and guidelines for the mechanisms under Articles 6, 12 and 17 of the Kyoto Protocol submitted by Parties in accordance with decision 7/CP.4 (see FCCC/SBSTA/1999/6, FCCC/SBI/1999/8).

  PROPUESTA PROVISIONAL DEL GOBIERNO DE CHILE PARA LA OPERACIÓN DE LOS MECANISMOS FLEXIBILES DEL PROTOCOLO DE KIOTO, EN

  PARTICULAR, EL MECANISMO DE DESARROLLO LIMPIO

   

  El Gobierno de Chile, en reuniones anteriores de los órganos subsidiarios y de la Conferencia de las Partes de la Convención Marco de Naciones Unidas sobre Cambio Climático, ha manifestado su interés de avanzar en acciones que pudieran orientar a la Conferencia de las Partes acerca de cómo operará finalmente el mecanismo de desarrollo limpio, estimando que ello podría lograrse mediante el desarrollo de una fase de aprendizaje, que incluirá el desarrollo de proyectos de reducción de gases con efecto invernadero demostrativos. En este sentido, y contando con el apoyo de otras Partes de la Convención, se está elaborando una propuesta para la creación de dicha fase.

  
  
  

  Sin perjuicio de lo anterior, y con el propósito de contribuir al desarrollo último del instrumento de reducción de emisiones de gases de efecto invernadero establecido en el Artículo 12 del Protocolo de Kioto, el Gobierno de Chile, tomando como base la decisión 7/CP.4 de la Convención y las conclusiones del documento FCCC/SB/1999/CRP.4, desea someter a consideración de las Partes las opiniones que se expresan a continuación.

  
  
  

  Consideraciones Generales

  
  
  

  1.- La gravedad de las consecuencias de una alteración del sistema climático del planeta, y la consecuente urgencia de eliminar, a la brevedad, las causas que lo origina, hacen necesaria una activa participación de todas las naciones, sin excepción, en la consecución de los objetivos de la Convención.

  
  
  

  2.- Esta activa participación debe darse en el marco del principio de "responsabilidades comunes pero diferenciadas" establecido en la Convención, y de acuerdo a las modalidades acordadas en ese tratado internacional y su(s) Protocolo(s).

   

  3.- El Mecanismo de Desarrollo Limpio (MDL), no es la única modalidad, pero es el único de los mecanismos económicos establecidos en el Protocolo de Kioto que permite a los países en desarrollo participar tempranamente en los esfuerzos globales de reducción y limitación de las emisiones netas de gases de efecto invernadero. Consecuentemente, el diseño del MDL debe cuidar de representar adecuadamente el principio de responsabilidades comunes pero diferenciadas de las Partes que hacen uso de este instrumento para el logro de los objetivos de la Convención.

  
  
  

  4.- Adicionalmente, en la medida que este mecanismo económico contribuya al desarrollo de un mercado internacional de transacciones de Certificados de Reducción de Emisiones (CREs) de Gases de Efecto Invernadero (GEI), especial atención se debe prestar, al momento de su diseño, a establecer las condiciones que aseguren la Integridad del sistema, entendida ésta como las condiciones de fiscalización que permitan la seguridad y transparencia de las mediciones y cuantificación de las reducciones de emisiones de GEI involucradas.

  
  
  

  5.- En consecuencia con lo anteriormente expuesto, el mercado de CREs se debe construir a partir de los resultados de actividades destinadas a reducir emisiones de GEI con, entre otras, las siguientes características:

  
  
  

  5.1.- Den garantía a la comunidad internacional que es compatible con el propósito de la Convención en el sentido de que los resultados de sus acciones signifiquen reducciones de las emisiones de GEI mensurables y a largo plazo en relación con la mitigación del cambio climático.

  
  
  

  5.2.- Contribuyan al desarrollo sustentable de las naciones donde se implementan, en el sentido que constituyan un cambio con respecto a la forma tradicional de realizar una actividad destinada a promover su desarrollo económico, agregando el propósito de reducir las emisiones de GEI asociados a ella.

  
  
  

  5.3.- Puedan demostrar con rigurosidad que las actividades de reducción de emisiones de GEI que él comprende no hubieran podido ser iniciadas de no existir este Mecanismo.

   

  5.4- Que la cantidad de toneladas de CO2 equivalente, o la unidad que se acuerde utilizar para expresar las reducciones consignadas en los CREs generados por ellos, sea sancionada por las Partes del Protocolo dentro de límites de error acordados como compatibles con los propósitos del cumplimiento de los objetivos de la Convención.

  
  
  

  5.5.- Que el resultado de sus acciones sea verificable a lo largo del tiempo y que, por lo mismo, haya seguridad de que en el mercado, en cualquier tiempo, existen sólo CREs efectivos, donde se han descontado aquellos originados a partir de proyectos abortados.

   

  6.- La autoridad para cualquier pronunciamiento sobre el tema de la sustentabilidad para el desarrollo de los proyectos partes del MDL, reside en las decisiones soberanas adoptadas por las instancias regulatorias del MDL existentes en los países donde ellos se llevaran a cabo. A la instancia regulatoria internacional del MDL, sólo le compete pronunciarse, si es el caso, sobre la consistencia entre esos pronunciamientos y lo establecido en los acuerdos internacionales vigentes que digan relación con esas materias.

  
  
  

  7.- Cualquier actividad relacionada con las categorías de suelos agrícolas, cambio de uso de la tierra y silvicultura, que eviten las pérdidas de cobertura de biomasa, o la aumenten, son entendidas como actividades que contribuyen a reducir el aumento de las concentraciones de GEI, particularmente del CO2, en la atmósfera, y por tanto "elegibles" para ser parte del MDL en acuerdo con los criterios de selección de proyectos adoptados por las Partes del Protocolo.

   

  7.1.- Las actividades elegibles deben ser compatibles con aquellas actividades señaladas en los artículos 3.3 y 3.4 del Protocolo de Kioto.

   

  8.- Toda acción que, derivada del desarrollo de proyectos, pudiera implicar acciones contrarias al libre comercio, serán sometidas a las reglas comerciales establecidas en los tratados internacionales suscritos por los Estados para estos efectos.

  
  
  

  9.- Cualquier institución pública, semi-pública, o privada de las partes No Anexo I, podrá concurrir unilateralmente al financiamiento y desarrollo de proyectos que califiquen bajo la modalidad de MDL, con el objeto de beneficiarse de los CREs que resulten de su desarrollo.

  
  
  

  10.- Se entiende que una vez que un CRE es "certificado" bajo el MDL, este se constituye en un valor comercial, sujeto a todas las posibles transacciones propias de un mercado de valores, sólo acotadas por una eventual pérdida de su vigencia de acuerdo a los motivos que se pudieran derivar de la cesación del proyecto que le dio origen, o, en el caso de una proyección del Protocolo de Kioto en el tiempo, por la pérdida de su vigencia para un período de compromiso posterior por el haber sido ya utilizado en el anterior.

  
  
  

  11.- Los CREs transados se entenderán que implican para la institución pública o privada que la adquiere la transferencia de todas las obligaciones y riesgos que tiene la permanencia del proyecto en el tiempo. A estas transacciones les serán aplicables todas las reglas de comercio internacional existentes.

  
  
  

  12.- Todo proyecto que cumpla con los criterios establecidos por la Conferencia de la Partes, actuando como reunión de las Parte del Protocolo (COP/MOP), para llegar a ser parte del MDL, y sean validados como tales por las autoridades existentes para tales efectos en la estructura del mecanismo, podrán solicitar a la autoridad respectiva del MDL la verificación y acreditación de las reducciones de emisiones logradas retroactivamente a la fecha del inicio del proyecto, pero no antes que la Parte donde se llevó a cabo el proyecto haya ratificado el Protocolo, y nunca antes del año 2000.

  
  
  

  En particular, todos los proyectos llevados a cabo de la fase Piloto de las Actividades Implementadas Conjuntamente, podrán hacer uso de este derecho.

  
  
  

  13.- Ninguna Parte podrá comprar o transar CREs sin antes haber ratificado el Protocolo.

  
  
  

  14.- Parte de los recursos que se obtendrán con la transacción de CREs conformarán un Fondo de Adaptación, con el propósito de ayudar a cubrir los costos de adaptación de aquellos países en desarrollo particularmente vulnerables a los efectos adversos del cambio climático. Estos recursos, según directrices que deberá elaborar la Conferencia de las Partes, actuando como la Reunión de las Partes del Protocolo, serán gestionados en su asignación y contabilidad, por la entidad que opera como el Mecanismo Financiero de la Convención. Por lo que no será materia del MDL la administración de los mismos.

  
  
  

  15.- A la utilización de este Fondo de Adaptación podrán optar todas las partes No Anexo I que califiquen como países particularmente vulnerables a los efectos adversos del cambio climático, con prioridades de acuerdo a un Índice de Vulnerabilidad que será desarrollado por las Partes del Protocolo.

  
  
  

  16.- Aquellas Partes No Anexo I que, además de calificar como países particularmente vulnerables a los efectos adversos del cambio climático, hayan generado o se encuentren generando CREs bajo el mecanismo de desarrollo limpio, tendrán prioridades adicionales a las

  
  
  

  establecidas en el Índice de Vulnerabilidad para el acceso a los recursos del Fondo de

  Adaptación.

  
  
  

  Consideraciones sobre la Institucionalidad Regulatoria.

  
  
  

  1.- La institucionalidad regulatoria del MDL estará conformada por un conjunto de entidades que, para los efectos de esta presentación, se denominarán en adelante:

  · Autoridad Nacional del MDL (AN/MDL),

  · Autoridad Internacional, que en la nomenclatura del Artículo 12 corresponde a la Junta Ejecutiva de este mecanismo (JE/MDL),

  · Entidades Especializadas en la Validación de Proyectos destinados a reducir emisiones de GEI, (EEVP)

  · Entidades Especializadas en la Verificación de Declaraciones de Reducciones de GEI, (EEVDR)

  · COP/MOP

   

  Sus roles y funciones de describen a continuación.

  
  
  

  Las autoridades nacionales

  
  
  

  2.- Las entidades básicas y fundamentales de este sistema regulatorio internacional del MDL son las AN/MDL.

  
  
  

  En ellas residen las responsabilidades siguientes:

  
  
  

  2.1.- Las acciones destinadas a difundir la existencia de este mecanismo y crear las capacidades de su utilización a nivel nacional.

  
  
  

  2.2.- El establecimiento de los criterios de aceptabilidad de proyectos en cuanto a su prioridad y pertinencia a un desarrollo nacional sustentable y en acuerdo a las decisiones que al respecto haya adoptado la COP/MOP.

  
  
  

  2.3.- El otorgar, a solicitud de los proponentes, de la certificación de consecuencia de los proyectos con los criterios nacionales de desarrollo sustentable.

  
  
  

  2.4.- El avalar a nivel nacional la información que los proponentes hacen en relación a un proyecto destinado a reducción de emisiones de GEI, en particular la propuesta de "línea base" que ellos hacen para su ciclo de vida

  
  
  

  2.5.- El otorgar, a solicitud de los proponentes, la aprobación nacional a una propuesta de proyecto de reducción de GEI en acuerdo a los criterios nacionales adoptados para tales efectos.

  
  
  

  2.6- El someter a la JE/MDL, a solicitud de los proponentes de un proyecto destinado a emitir CREs, toda la información requerida para su trámite de validación, de acuerdo a un formato de reporte uniforme establecido por la COP/MOP. Entre la información mínima que debería incluir este reporte se distingue:

  
  
  

  a) la certificación de su pertinencia a los objetivos de un desarrollo nacional sustentable.

  
  
  

  b) su descripción pormenorizada, con especial atención a las actividades que se llevarán a cabo con el propósito de reducir emisiones de GEI.

  
  
  

  c) la documentación que avala la propuesta de "línea base" que se plantea para su ciclo de vida.

  
  
  

  d) su aprobación nacional.

  
  
  

  2.7.- El someter a la JE/MDL, a solicitud de los proponentes de un proyectos validado para emitir CREs, toda la información que de respaldo a la reducción de GEI lograda por este proyecto en un período de tiempo determinado de su implementación, y por el cual se busca reconocimiento internacional.

  
  
  

  2.8.- El informar, oportunamente, a la JE/MDL del término anticipado de cualquier proyecto nacional validado paras emitir CREs, aportando los antecedentes de las razones existentes para ello y, principalmente, de las consecuencias que esta situación significará para la validez futura de los CREs que han sido certificados como resultado de las actividades de dicho proyecto desde su inicio hasta esa fecha.

  
  
  

  La autoridad internacional

  
  
  

  3.- A la JE/MDL le corresponden las siguientes responsabilidades:

  
  
  

  3.1.- Realizar la selección de las EEVP de reducción de GEI, que conformarán un registro internacional único que dará garantías de idoneidad a todas la Partes del Protocolo en su labor de informar técnicamente sobre los requerimientos que la comunidad internacional ha impuesto a los proyectos merecedores de otorgar CREs. A fin de efectuar esta selección, la JE/MDL deberá acordar los términos de referencia respectivos con acuerdo de la COP/MOP.

  
  
  

  3.2.- Cada vez que así sea requerido, recepcionar la solicitud que una AN/MDL le haga llegar para iniciar un proceso de validación internacional de un proyecto destinado a reducir emisiones de GEI, cuidar de la completitud de la información requerida para proceder a dicho trámite, y escoger desde el registro único internacional de entidades especializadas en validación de proyectos de reducción, una que le permita disponer de un informe técnico para pronunciarse con propiedad sobre ella.

  
  
  

  3.3.- Pronunciarse, sobre la base de los antecedentes y recomendaciones realizadas por una entidad integrante del registro único internacional de instituciones especializadas en la validación de proyectos de reducción, sobre la aceptación internacional del proyecto como parte del MDL.

  
  
  

  3.4.- Cuidar de que toda vez que un proyecto sea validado, éste sea incorporado a un registro único internacional, donde se le asignará un número de identificación y constará una descripción de la actividad de reducción de GEI que se llevará a cabo y la descripción de la línea base que hará uso el proyecto para cuantificar las cantidades de unidades de reducciones que el producirá a lo largo de su ciclo de vida. Además, el registro también registrará el nombre de la entidad técnica que emitió el informe de validación y la fecha de su aceptación por parte de la entidad ejecutiva máxima del MDL.

   

  3.5.- Realizar la selección de las entidades especializadas en verificación de reducciones logradas (EEVDR), que conformarán un registro internacional único que dará garantías de idoneidad a todas la Partes del Protocolo en su labor de informar técnicamente sobre la veracidad de lo expresado en una declaración de reducción que busca reconocimiento internacional. A fin de efectuar esta selección, la JE/MDL deberá acordar los términos de referencia respectivos con acuerdo de la COP/MOP.

  
  
  

  3.6.- Cada vez que así sea requerido, recepcionar la solicitud que una AN/MDL le haga llegar para iniciar un proceso de validación internacional de una declaración de reducción lograda por un proyecto válido de reducción de emisiones de GEI en un determinado periodo de su ejecución, cuidar de la completitud de la información requerida para proceder a dicho trámite, y escoger desde el registro único internacional de entidades especializadas en verificación de reducciones logradas, una que le permita disponer de un informe técnico para pronunciarse con propiedad sobre ella.

  
  
  

  3.7.- Certificar, sobre la base de los antecedentes y recomendaciones realizadas por una entidad integrante del registro único internacional de instituciones especializadas en la verificación de declaraciones de reducciones logradas, que la comunidad internacional esta de acuerdo con lo expresado en la declaración de reducción que busca reconocimiento, y por lo tanto, ella se transforma en un CRE transable en el mercado internacional.

  
  
  

  3.8.- Cuidar de que toda vez que una declaración de reducción haya adquirido el estatus de CRE, ésta sea incorporada a un registro único internacional, donde se le asignará un número de identificación, constatará la cantidad de unidades de reducciones asociadas, el número del proyecto que les dio origen, el período de tiempo en que ellas se originaron, la entidad técnica que emitió el informe de verificación y la fecha de su "certificación".

  
  
  

  3.9.- En las situaciones de haber recibido una comunicación oficial, por parte de una AN/MDL, del término de las actividades de algún proyecto, actualizar el registro único internacional de proyectos validados, como también el de CREs certificados, en consecuencia con esta información. Esto significará dejar constancia expresa del término del proyecto en la entrada correspondiente del registro de proyectos, y si ello tuviera efecto sobre la vigencia de los CREs asociados, señalar este hecho en las entradas correspondientes del registro de CREs certificados. En forma adicional, será también su responsabilidad incorporar en un tercer registro, que existirá expresamente para tales efectos, el número de registro del proyecto validado que ha finalizado sus actividades, su título, y los número de registro de los CREs asociados que han perdido vigencia, si ese es el caso.

  
  
  

  3.10.- Proponer a la COP/MOP la magnitud de los cargos que se deberán realizar a las transacciones comerciales de CREs con el propósito de solventar sus costos de operación administrativos.

  
  
  

  3.11.- Proponer a la COP/MOP, todas las medidas conducentes a otorgar a los potenciales participantes del mecanismo la información y capacitación para su utilización plena y, consecuentemente, igualdad de oportunidades para acceder a los beneficios que de ella pudieran derivarse. Incluida las medidas para "ayudar según sea necesario a organizar la financiación de actividades de proyectos certificados". No obstante, un activo desempeño en búsqueda de minimizar las distorsiones inherentes a la instalación de este mercado, no puede confundirse con roles de la JE/MDL en la implementación del mercado, tales como el de agente de inversiones, agente de transacciones de CREs, regulador de precios, u otros similares.

  
  
  

  Las entidades especializadas

  
  
  

  4.- Será el cometido de las entidades integrantes del registro único de EEVP destinados a reducir emisiones de GEI, emitir informes técnicos sobre los proyectos para los cuales la JE/MDL le solicite pronunciarse, en que:

  
  
  

  4.1.- Se verifique la consistencia existente entre los antecedentes aportados por la autoridad nacional del MDL que solicita la validación del proyecto y:

  
  
  

  a) las obligaciones provenientes de toda otra convención o tratado internacional vigente que diga relación con las actividades comprendidas en el proyecto.

  
  
  

  b) los criterios generales acordados por las Partes para servir de guía al establecimiento de líneas bases de proyectos.

  
  
  

  4.2.- Se establezca el grado de seguridad que ofrece el proyecto analizado en cuanto a una adicionalidad ambiental mensurables dentro de límites de error compatibles con la existencia de un mercado internacional para los CREs.

  
  
  

  5.- Será función de las EEVDR de GEI por parte de proyectos validados, pronunciarse sobre los antecedentes aportados por una AN/MDL en nombre de los autores del proyecto, toda vez que la JE/MDL le solicite un informe técnico al respecto, pudiendo para ello realizar todas las mediciones necesarias en terreno, de acuerdo a las guías metodológicas acordadas por las Partes, que le permitan entregar un informe técnico en propiedad sobre lo afirmado en la declaración de reducción de GEI que busca reconocimiento internacional oficial.

  
  
  

  La COP/MOP

  
  
  

  6.- Será función de la COP/MOP, en relación a la ejecución del MDL:

  
  
  

  6.1.- Establecer la JE/MDL, la que debe estar compuesta de un número pequeño de representantes de las Partes en el Protocolo, los que serán seleccionados según una representación geográfica equitativa, pero asegurando un balance adecuado entre países

  Anexo I y No-anexo I.

  
  
  

  6.2.- Pronunciarse sobre "la parte" de los compromisos cuantitativos de reducción o limitación de emisiones que un país del Anexo B del Protocolo de Kioto pueda "cumplir" por el uso de CREs.

  6.3.- Adoptar una acuerdo sobre el límite máximo de error a que puedan estar sujetos los valores consignados en los CREs, que se considerarán compatibles con la existencia de un mercado internacional para los CREs.

  
  
  

  6.4.- Encomendar al Panel Intergubernamental sobre Cambio Climático el establecimiento, y revisión periódica, de listados de tipos de proyectos de reducción de emisiones de GEI que por sus características dan garantía de que ellas pueden ser cuantificadas dentro de los márgenes de error establecidos por la COP/MOP para la existencia de un mercado internacional de CREs y cuya perduración en el tiempo es compatible con los propósitos de la Convención, y adoptarlas con el propósito de que sean utilizadas por las AN/MDL al momento de dar aprobación nacional a una propuesta de proyecto de reducción de GEI.

  
  
  

  6.5.- Encomendar al Panel Intergubernamental sobre Cambio Climático el establecimiento, y revisión periódica, de guías metodológicas para el establecimiento de líneas base para proyectos que tienen por propósito reducir emisiones de GEI, y adoptarlas con el propósito de que sean utilizadas por los proponentes de proyectos al momento del análisis de ellos a nivel nacional, y por parte de las entidades del registro internacional especializado en validación de proyectos.

  
  
  

  6.6.- Encomendar al Panel Intergubernamental sobre Cambio Climático el establecimiento, y revisión periódica, de guías metodológicas para la verificación de declaraciones de reducción de emisiones de GEI realizadas por proyectos que son parte del MDL, y adoptarlas con el propósito de que sean utilizadas por los proponentes que buscan reconocimiento internacional de CREs, y por parte de las entidades del registro internacional especializado en verificación de declaración de reducciones de GEI.

  
  
  

  6.7.- Aprobar los términos de referencias, propuestos por la JE/MDL, para efectuar la selección de las EEVP y las EEVDR que conformarán los registros internacionales únicos respectivos.

  
  
  

  6.8.- Aprobar la magnitud de los cargos, propuestos por la JE/MDL, que se deberán realizar a las transacciones comerciales de CREs con el propósito de solventar los costos de operación administrativos de esa entidad.

  
  
  

  6.9.- Pronunciarse sobre la magnitud de los cargos que se deberán realizar a las transacciones comerciales de CREs que depositarán en el Fondo de Adaptación, con el propósito de "ayudar a las Partes que son países en desarrollo particularmente vulnerables a los efectos adversos del cambio climático, a hacer frente a los costos de adaptación".

  
  
  

  6.10.- Desarrollar un Índice de Vulnerabilidad que permita asignar prioridades de acceso de los recursos del Fondo de Adaptación a las partes No Anexo I que califiquen como países particularmente vulnerables a los efectos adversos del cambio climático, incluyendo los criterios para asignar prioridades adicionales a aquellas partes No Anexo I que lleven a cabo proyectos que sean parte del MDL.

  
  
  

  6.11.- Elaborar las directrices con que deberá operar el Mecanismo Financiero de la Convención para administrar y asignar los recursos del Fondo de Adaptación.

  CLEAN DEVELOPMENT MECHANISM

  In previous meetings of the Conference of the Parties to the UNFCCC and its subsidiary bodies, the Government of Chile has expressed a strong interest in moving forward in actions that might guide the COP about the operational aspects of the CDM. It believes that this could be achieved by the development of a-learning-by-doing phase, which will include the implementation of demonstrative GHG reduction projects. In this sense, and supported by other parties to the Convention, a proposal for the establishment of such phase is being prepared.

  
  
  

  In spite of the above and in order to contribute to the final development of the GHG reduction tool, established in Article 12 of the Kyoto Protocol, the Government of Chile, taking into account decision 7/CP.4 and conclusions under document FCCC/SB/1999/CRP.4, wishes to submit for the consideration of the FCCC Parties, the following views on CDM:

  1.- The seriousness of an alteration of the Planet's climate system along with the urgency of eliminating as soon as possible the causes of such disruption, makes necessary the active participation of all Parties, with no exception, in the attainment of the FCCC objectives.

  
  
  

  2.- This active participation should be done under the framework of "common but differentiated responsibilities" established in the FCCC and should be in accordance with the modalities adopted by this international treaty and related Protocol (s).

  
  
  

  3.- The Clean Development Mechanism (CDM) is not the only modality, nevertheless, is the only Kyoto mechanism which allows for an early participation of Non-Annex 1 countries in the reduction and/or limitation of net GHG emissions. Consequently, the CDM design should take care of an adequate representation of the principle of common but differentiated responsibilities of those Parties that will use this mechanism to accomplish the UNFCCC objectives.

  
  
  

  4.- In addition, as this economic mechanism could contribute to the development of an international trading market for GHG Certified Emission Reductions (CERs), special attention should be given to the establishment of certain conditions during its designing stage, in order to ensure the system's integrity: i.e., the establishment of enforcement conditions that will allow for security and transparency in the certification of GHG reductions.

  
  
  

  5.- In line with the aforementioned, the CERs market should be built based on the results of GHG reduction activities that must have, inter-alia, the following characteristics:

  5.1.- Guarantee the international community that the project activity is compatible with the objective of the UNFCCC, in a sense that the GHG emission reductions gained by the project will be measurable and that the mitigation measures will lead to long-term benefits for climate change.

   

  5.2.- Contribute to the sustainable development of parties where project activities are taking place, in a sense that it should imply a change in the traditional way of implementing an economic development activity, by adding the purpose of reducing GHG emissions associated to that particular activity.

  
  
  

  5.3.- Rigorously demonstrate that the GHG emission reduction activities considered in the project are not feasible unless this mechanisms is in place.

  
  
  

  5.4- That the amount of tons of CO2 equivalent -- or other unit that will finally be adopted to express the reductions claimed in the CERs generated by a project activity-- should be sanctioned by the Parties to the Protocol, considering adequate error limits compatible with the accomplishment of FCCC objectives.

  
  
  

  5.5.- That the results of the project activities should be verifiable in the long-term (i.e., the project's lifetime), and for that reason, there should be certainty, at any time in the market, that only effective CERs will be available for acquisition, and therefore, those CERS originated from aborted projects have been already deducted.

  
  
  

  6.- The authority for any statement on the issue of sustainability of CDM projects, resides in the sovereign decisions adopted by the CDM national regulatory entities that will be set up in the Parties where the projects will take place. The international regulatory authority (i.e., the Executive Board) will only make a declaration, if necessary, on the consistency between the sustainability claims of CDM projects and the international agreements that deal with the issue of sustainable development.

  
  
  

  7.- Any activity related to the categories of agricultural soils, land use change and forestry, that would avoid biomass coverage losses or, on the contrary, would promote biomass gains, should be recognized as activities that contribute to reduce the rise in GHG concentrations in the atmosphere, particularly of CO2, and therefore, should be eligible as part of the CDM project activities, in accordance to the project selection criteria adopted by the Parties to the Protocol.

  
  
  

  7.1.- The eligible activities must be compatible with those activities noted in articles 3.3 and 3.4 of the Kyoto Protocol.

   

  8.- Any action that, driven from a project development might involve negative impacts to the free market, will be subjected to the commercial rules established for that purpose in the in force international agreements.

  
  
  

  9.- Any public, semi-public or private entity from a non-annex 1 Party, can -- unilaterally--apply for the financing and development of projects qualified under the CDM, in order to take advantage of the CREs generated.

  10.- It is understood that, once a CRE is certified under the CDM, it automatically constitutes a commercial value subjected to every possible transaction that is inherent to a stock market activity, and this transaction being restricted only by the potential loss of soundness of the CRE, in accordance to the reasons that made the project activity originating the CRE no longer viable. Or, in the case of the projection in time of the Protocol (i.e., for a second or third commitment period), the soundness of the CRE will be lost for the next commitment period if it was used in the previous period.

  
  
  

  11.- The traded CREs will also implicate --for the private or public entity acquiring them-- the transference of all the obligations and risks driven from the project permanence in time. Every existing international trading rule will be applied to this transaction.

  
  
  

  12.- For every project that fulfils the criteria established by the COP/MOP in order to become part of the CDM and be validated by the corresponding authorities of the CDM, a participating Party can request for the retroactive verification and accreditation of the emission reductions gained since the initiation of the project, but not before the Party where the project took place had ratified the Protocol, and never before the year 2000.

  
  
  

  In particular, every project developed under the AIJ Pilot Phase, can make use of this right.

  
  
  

  13.- No Party will be able to buy or sell CREs if it has not ratified the Protocol.

   

  14.- Part of the resources obtained through the transaction of CERs will go to an adaptation fund, with the purpose of assisting those developing Parties that are particularly vulnerable to the climate change impacts, to cover their adaptation costs. The partition and accounting of these resources, according to the guidelines that should be developed by the COP/MOP, will be managed by the entity operating as the UNFCCC financial mechanism. Therefore, the administration of those resources will not be part of the CDM operational aspects.

  
  
  

  15.- The adaptation fund would be used by those non-annex 1 parties qualifying as "particularly vulnerable" to the climate change impacts, and their priorities will be established according to a Vulnerability Index set up by the Parties to the Protocol.

  
  
  

  16.- Those Non-annex 1 Parties which, in addition to qualify as particularly vulnerable, have been generating CREs under the CDM, will have additional priorities to those established in the vulnerability index, in order to facilitate their access to the adaptation fund resources.

  
  
  

  Considerations on the CDM regulatory institutional framework

  
  
  

  1.- The institutional regulatory framework of the CDM will be conformed by the following entities:

  
  
  

  · National Authority for the CDM (NA/CDM),

  · International Authority. According to the wording in Article 12, it corresponds to the Executive Board of the CDM (EB/CDM)

  · Specialized Entities for the Validation of Projects to reduce GHG emissions (SEVP)

  · Specialized Entities for the Verification of GHG emission Reductions (SEVR), and

  · COP/MOP

  
  
  

  Their roles and functions are described as follows.

  
  
  

  National Authority

  
  
  

  2.- The basic and fundamental entity of the MDL international regulatory system is the NA/CDM, which has the following responsibilities:

  
  
  

  2.1.- To spread out the existence of the CDM (education and public outreach) and to create the local capacity to make use of the CDM.

  
  
  

  2.2.- To establish the criteria for projects acceptance, taking into account the priorities and relevance of project activities to the national sustainable development, and considering their congruence with decisions of the COP/MOP on sustainability matters.

  
  
  

  2.3.- To provide, upon the proponents request, a certification of the convenience of CDM projects with national sustainable development criteria.

  
  
  

  2.4.- To endorse, at the national level, the information of a GHG emission reduction project provided by the proponent, in particular, the proposed baseline for the overall project's lifecycle.

  
  
  

  2.5.- To provide, upon the proponents request, the national approval to a proposal for a GHG emission reduction project, in accordance to the national criteria for project acceptance.

  
  
  

  2.6- To submit for the consideration of the EB/CDM, upon the proponents request, all the information --required for international validation-- of a project which will generate CREs, according to a uniform reporting format established by the COP/MOP. The least information that this report should include is:

  
  
  

  a) The certification of the project's pertinence to the national sustainable development objectives.

  
  
  

  b) A detailed description of the project, with special emphasis in the GHG emission reduction activities.

  
  
  

  c) The documentation supporting the baseline proposal for the project's lifecycle.

  
  
  

  d) National endorsement of the project.

  
  
  

  2.7- To submit for the consideration of the EB/CDM, upon the proponents request of a project validated to emit CREs, all the information that guarantees the effective GHG emission reduction attained by the project in a certain period, for which international recognition is needed.

  
  
  

  2.8.- To inform the EB/CDM, opportunely, the anticipated ending of a national project validated to emit CREs, providing the reasons of such ending, and mainly, stating the consequences that this situation will imply to the future validation of the CREs that were certified under the project lifetime.

  
  
  

  The international Authority

  
  
  

  3.- The EB/CDM has the following responsibilities:

  
  
  

  3.1.- To select the Specialized Entities for the Validation of Projects to reduce GHG emissions (SEVP), which will conform a unique international registry that will guarantee competence to all parties to the Protocol on its technical work regarding CER validation. In order to put in place the selection process, the EB/CDM will develop the terms of reference for these entities in accordance with COP/MOP considerations on this matter.

  
  
  

  3.2.- To receive, when so required, a submission from a National Authority for the CDM (NA/CDM), which will seek to initiate an international validation process for a GHG emission reduction project. The EB/CDM should check the completeness of the information needed to initiate the process and should select, from the unique international registry of SEVP, an appropriate entity which will develop a technical report.

  
  
  

  3.3.- To enunciate, based on the recommendations of the selected SEVP, the international acceptance of a project as part of the CDM.

  
  
  

  3.4.- To ensure that each time a project is validated, it will be incorporated in a unique international registry of CDM projects, where an identification number will be assigned and a description of both the project activities and the baseline approach will be included. In addition, the registry will include the name of the technical entity which submitted the validation report, as well as the date of acceptance by the EB/CDM.

  
  
  

  3.5.- To select the Specialized Entities for the Verification of GHG emission Reductions

  (SEVR), which will conform a unique international registry that will guarantee competence to all Parties to the Protocol on its work of technically ensuring the truthfulness of a GHG reduction declaration seeking for international recognition. In order to put in place the selection process, the EB/CDM will develop the terms of reference for these entities in accordance with COP/MOP considerations on this matter.

   

  3.6.- To receive, when so required, a submission from a National Authority for the CDM (NA/CDM) for the initiation of an international validation process for a GHG emission reduction declaration attained by a CDM project. The declaration should specify what project implementation period is being covered. The EB/CDM should check the completeness of the information needed to initiate that process and should select, from the unique international registry of SEVR, an appropriate entity that will develop a technical report.

  
  
  

  3.7.- To certify, based on the recommendations of the selected SEVP, that the international community is in accordance with the GHG reduction declaration seeking for recognition, and therefore, such declaration becomes a CRE tradable in the international market.

  
  
  

  3.8.- To ensure that each time a GHG reduction declaration becomes a tradable CRE, it will be incorporated to a unique international registry where an identification number will be assigned. The EB/CDM will also verify the number of reduction units claimed, the number of the project that generated them, the time period covered by the reduction units (CRE), the technical entity responsible for the report and the certification date.

  
  
  

  3.9.- In situations when an official notification is received from a NA/CDM regarding the ending of a certain project activity, the EB/CDM should update the international unique registry of validated projects, as well as the registry of certified CREs. This will leave a written evidence in the corresponding entry of project registration, and, if the project ending will implicate consequences to the CERs validness, this should be stated in the corresponding entry of the CREs registry. Additionally, the EB/CDM will be responsible for incorporating in a third registry (created for such purposes), the registry number of the concluded project, its title, and the registry numbers of the associated CREs that have lost their validness (if that is the case).

  
  
  

  3.10.- To propose to the COP/MOP the amount of charges that should be applied to the CERs transactions, in order to meet the administrative costs of the EB/CDM.

  
  
  

  3.11.- To propose to the COP/MOP the necessary measures that will provide the potential participants in the CDM with all the information and capacity building to make full use of this mechanism, and, consequently, ensure equal opportunities to all participants in the access to the benefits that a CDM activity might supply (including measures to assist in the financing of certified project activities). Nevertheless, an active role of the EB/CDM in minimizing the distortions that are inherent to the establishment of a CRE market, must not be mixed up with roles of the EB/CDM during the implementation phase of the CDM, like investment agent, CRE transaction agent, price regulator or other denominations, since those will be managed by other stakeholders.

   

  Specialized Entities

  
  
  

  4.- The Specialized Entities for the Validation of Projects to reduce GHG emissions (SEVP), listed in the unique international registry for this purpose, will have the responsibility of preparing technical reports for CDM projects --upon a request of the EB/CDM-- in which:

  
  
  

  4.1.- The consistency of the information provided by the National Authority for the CDM requesting project validation must be verified, in addition to:

  
  
  

  a) the obligations established in other conventions or international treaties that could be related to the project activities.

  
  
  

  b) the general criteria, agreed by Parties, guiding the development of the project baseline

  
  
  

  4.2.- The level of assurance offered by the project regarding a measurable environmental additionality, within error limits compatible with the existence of an international CRE trading market, must be verified.

  
  
  

  5.- The Specialized Entities for the Verification of GHG emission Reductions (SEVR), will review the information provided by a NA/CDM and emit a technical report to the EB/CDM upon its request. The SEVR will carry out all the necessary field measures, according to methodological guidelines adopted by Parties, in order to prepare a comprehensive technical report on the GHG emission reduction declaration that seeks for international recognition.

  
  
  

  The COP/MOP

  
  
  

  6.- In the implementation phase of the CDM, the COP/MOP will have the following functions:

  
  
  

  6.1.- To Establish the EB/CDM, which should be conformed by a small number of representatives from Parties to the Protocol, which will be selected according to an equitable geographical representation, but at the same time, ensuring an adequate balance between Annex 1 and Non-Annex 1 Parties

  
  
  

  6.2.- To enunciate "the part" of the QUELROS that an Annex B Party to the Protocol can comply by using the CREs.

  
  
  

  6.3.- To adopt an agreement on the maximum error limit that a CRE assign value can be subjected to, which would be considered compatible with the existence of a CRE international trading market.

  
  
  

  6.4.- To request the Intergovernmental Panel on Climate Change, IPCC, the establishment and periodic review of a list of GHG emission reduction projects, which characteristics could guarantee that GHG reductions will be measurable within error limits set up by the COP/MOP for a CRE international trading market, and that the duration of reductions will be compatible with UNFCCC objectives. The list should be adopted by parties and utilized by the NA/CDM when giving national endorsement to a proposal for a GHG reduction project.

  
  
  

  6.5.- To request the IPCC, the establishment and periodic review of methodological guidelines for the development of GHG emission reduction project baselines. The guidelines should be adopted by parties in order to be utilized by both project proponents and the Specialized Entities for the Validation of Projects (SEVP).

  
  
  

  6.6.- To request the IPCC, the establishment and periodic review of methodological guidelines for the verification of GHG remission reduction declarations attained by projects under the CDM. The guidelines should be adopted by parties in order to be utilized by both the project proponents and by the Specialized Entities for the Verification of GHG emission Reductions declarations (SEVR).

  
  
  

  6.7.- To approve the terms of reference proposed by the EB/CDM, for the selection of the SEVR and SEVP which will integrate the corresponding unique international registries.

  6.8.- To approve the amount of charges, proposed by the EB/CDM, that should be applied to the CERs transactions in order to meet the administrative costs incurred by the EB/CDM.

  
  
  

  6.9.- To enunciate the amount of charges that should be applied to the CERs transactions, that will go to an Adaptation fund, with the purpose of assisting those developing Parties that are particularly vulnerable to the climate change impacts, to cover their adaptation costs.

  
  
  

  6.10.- To develop a Vulnerability Index that will allow for the assignment of priorities to non-annex 1 parties, qualifying as "particularly vulnerable" to the climate change impacts, for accessing the Adaptation Fund, including criteria to assign additional priorities for those Non-Annex 1 Parties which have been generating CREs under the CDM.

  
  
  

  6.11.- To elaborate the guidelines for the UNFCCC Financial Mechanisms to administrate and assign the Adaptation Fund resources.

  
  
  

   

  PAPER NO. 2: REPUBLIC OF KOREA

  
  
  

  Submission by the Republic of Korea on the CDM(Addendum)

   

   

  Introduction

   

  1. The Republic of Korea submitted its initial position on the Clean Development Mechanism (CDM) on June 1999, which is included in the FCCC/SB/1999/MISC.3/Add.2, and this is an addendum to the previous submission. This submission further elaborates on which greenhouse gas (GHG) emission reduction projects should be approved as CDM projects, one of the core issues which needs to be resolved in order for the CDM to become an effective means of fighting against climate change.

   

  Criteria for CDM Projects

   

  2. As suggested in the previous submission, Korea considers that CDM projects should meet the following additionality conditions :

   

  - Emissions additionality: CDM projects should achieve real, measurable and long-term GHG emission reductions.

  
  
  

  - Investment additionality : Projects which are commercially viable without emission credits should not qualify as CDM projects.

  
  
  

  - Financial additionality : Official Development Assistance (ODA) projects should not be considered as CDM projects.

   

  - Technology additionality : Technology for CDM projects should be appropriate for non-Annex I Parties and meet best available technology standards.

   

  3. Among the above additionality conditions, investment additionality deserves greater attention. If there is no distinction between Foreign Direct Investment (FDI) and CDM investment, FDI, which takes place on a commercial basis even without emission credits, could be repackaged as CDM investment, and obtain emission credits. This will result in an overflow of emission credits, which will have adverse effects on global efforts to fight against climate change.

   

  4. Distinguishing between FDI and CDM investment is not an easy task and requires further elaboration. Korea, however, considers that the concept of concessionality which applies to ODA can be considered as an exemplary criterion. According to OECD/DAC (Development Assistance Committee), ODA is required to have a "grant element" of at least 25 per cent. Additionally, the concept of the normal internal rate of return can also be considered to be a criterion for distinguishing FDI and CDM investment. Investment made below the level of the normal internal rate of return should be considered as CDM investment.

  Projects Between Non-Annex I Parties

   

  5. In the case that criteria to clearly distinguish between FDI and CDM investment can not be agreed upon, and FDI and CDM investment run the risk of being mixed, it is desirable to review whether GHG emission reduction projects between non-Annex I Parties can qualify as CDM projects and accordingly granted emission credits.

   

  6. In a situation where FDI and CDM investment are not clearly distinguished and emission credits are granted only to the projects between Annex I and non-Annex I Parties, and not to those between non-Annex I Parties, the problem of distortions in market competitiveness among Annex I and non-Annex I Parties' businesses will inevitably arise and unfair advantages to Annex I Parties will naturally follow. This case is very clear when Annex I Parties' businesses compete against non-Annex I Parties' for GHG emission reduction projects in non-Annex I Parties, taking advantage of emission credits obtained through FDI, not CDM investment.

   

  7. In addition, in light of the purpose of the CDM stipulated in Article 12.2 of the Kyoto Protocol, that is to assist non-Annex I Parties in achieving sustainable development and in contributing to the ultimate objective of the Climate Change Convention, and to assist Annex I Parties in achieving compliance with their commitments, Korea believes that GHG emission reduction projects between non-Annex I Parties can satisfy the purpose of the CDM and accordingly should be approved as CDM projects under the above additionality conditions.

   

  8. If GHG emission reduction projects between non-Annex I Parties are approved as CDM projects, non-Annex I Parties will be considerably more conducive to sustainable development on account of attracting investment from other non-Annex I Parties. Such investment is additional to Annex I Parties' investment, and can substantially contribute to fighting against climate change. As for Annex I Parties, they can comply cost-effectively with their commitments by purchasing emission credits created in the implementation of projects between non-Annex I Parties.

   

  Early Action by Non-Annex I Parties

   

  9. In order to provide an incentive for non-Annex I Parties to implement requisite policies and measures to limit or reduce GHG emissions, it is worthwhile reviewing the possibility to allow non-Annex I Parties to have emission credits for their voluntary early action.

   

  10. Within the framework of the CDM, non-Annex I Parties will tend to play a passive role in limiting or reducing GHG emissions, while relying on Annex I Parties' investment. Thus there should be a specific formula which can make non-Annex I Parties more pro-active in limiting or reducing GHG emissions. [End]
