DRAFT DECISION ON THE SECOND REVIEW OF THE ADEQUACY OF

SUB-PARAGRAPHS (a) AND (b) OF PARAGRAPH 2 OF ARTICLE 4

OF THE CONVENTION



The Conference of the Parties, at its Fourth Session,



HAVING REVIEWED sub-paragraphs (a) and (b) of Article 4.2 of the Convention, which relate to the commitments of Parties included in Annex 1, in accordance with sub-paragraph (d) of Article 4.2, and having concluded that they are inadequate,



HAVING ASCERTAINED that, according to the national communications submitted by Parties included in Annex II of the Convention, their collective greenhouse gas emissions have increased since the entry into force of the Convention, in spite of their commitment of aiming to return, individually or jointly, to their 1990 levels by the year 2000,



DEEPLY CONCERNED that current projections indicate a continued growth of the emissions of most of the Parties included in Annex 1,



REGRETTING that the Kyoto Protocol , which has yet to enter into force, provides for no reduction commitments on the part or Parties included in Annex 1 before the year 2008,



FEARING that, if present trends are allowed to continue unchecked, eventual compliance with the Kyoto Protocol could be seriously compromised,



1. DECIDES that developed country Parties shall make genuine efforts to return their greenhouse gas emissions to 1990 levels as stipulated under subparagraphs (a) and (b) of Article 4.2 of the Convention.



2. DECIDES that firm guidelines shall be established, no later than the Fifth Session of the Conference of the Parties, to ensure that Parties included in Annex 1 that have made little or no progress in stabilizing or reducing their greenhouse gas emissions achieve demonstrable progress by year 2005 at the latest.



3. INSTRUCTS the Subsidiary Body for Implementation and the Subsidiary Body for Scientific and Technical Advice to report on this matter to the Conference of the Parties at its Fifth Session.



4. URGES early ratification of the Kyoto Protocol by all Parties.
