I. OPENING OF THE SESSION

(Agenda item 1)



1. The ninth session of the Subsidiary Body for Implementation (SBI) was held at the Centro de exposiciones del Gobierno de la Ciudad de Buenos Aires, Buenos Aires, Argentina, from 3 to 10 November 1998.



2. The Chairman of the SBI, Mr. Bakary Kanté (Senegal), opened the session on 3 November 1998. He welcomed all delegates and observers to the session and thanked the Government of Argentina for its generous hospitality as the host of the fourth session of the Conference of the Parties (COP). The Chairman recalled that the COP had referred a number of its agenda items to the SBI, and noted that the SBI at its ninth session, should aim at preparing draft decisions on these items for recommendation to the COP for adoption. He observed that the SBI would need to work intensively in order to complete the work on the many items referred to it. He expressed confidence, however, that delegates would rise to this challenge and work together in a spirit of cooperation.



II. ORGANIZATIONAL MATTERS

3. At its 1st meeting, on 3 November, the SBI considered the provisional agenda contained in document FCCC/CP/1998/1, annex II.



4. The SBI adopted the following agenda:

B. Organization of work

(Agenda item 2 (b))



5. The SBI considered this sub-item at its 1st meeting, on 3 November. It had before it the tentative schedule of meetings contained in document FCCC/CP/1998/1/Add.1, annex III. The Chairman noted that the tentative schedule of meetings should be used as a guide to the organization of work of the SBI, but that flexibility would be required to respond to the pace of progress. The Chairman underscored that the SBI should complete its work by 10 November, to enable him to present recommended draft decisions to the COP in his report on 11 November.



6. The Chairman recalled that the COP, at its 2nd plenary meeting the previous day, had referred a number of items to the SBI for its consideration. Some of these had been allocated to both the SBI and the Subsidiary Body for Scientific and Technological Advice (SBSTA) for their joint consideration. The Chairman drew the attention of the SBI to the items before it, which were as follows:



-Calendar of meetings of Convention bodies 2000-2001

7. The Chairman recalled that, at the request of the COP, he had agreed to consult with the Chairman of the SBSTA on whether COP agenda item 4 (e), an item referred to the SBI, should also be considered by the SBSTA.



8. The Chairman noted that the previous day the COP had accorded observer status to the intergovernmental and non-governmental organizations listed in document FCCC/CP/1998/14 and Add.1, and accordingly these organizations would also be admitted as observers to the current session of the SBI.



9. Finally, the Chairman recalled that the COP, at its 2nd plenary meeting the previous day, had adopted a decision on the attendance of intergovernmental and non-governmental organizations at contact groups (decision 18/CP.4).(1) He noted that the SBI would adhere to this decision in its work.



C. Election of officers

(Agenda item 2 (c))



10. The SBI considered this sub-item at its 1st meeting, on 3 November. At that meeting, the Chairman informed the SBI that the Conference of the Parties had agreed to the President's proposal to conduct consultations with regard to nominations for the posts of vice-chairpersons and rapporteurs of the subsidiary bodies, with a view to their election as soon as possible during the current sessions of those bodies, and that he would keep delegates informed of any progress.



11. At the 8th plenary meeting of the COP, on 14 November, the President announced that agreement had been reached on the nomination of the remaining officers of the subsidiary bodies. On the invitation of the President, the COP elected Mr. Mohammad Reza Salamat (Iran), to replace Mr. José Romero (Switzerland) as Vice-Chairman from February 1999, and

Mr. Klaus Radunsky (Austria) as Rapporteur of the SBI.

 

III. MATTERS REFERRED TO THE SBI BY THE PLENARY

A. Calendar of meetings of Convention bodies 2000-2001

(Agenda item 2 (h) of the Conference of the Parties)



1. Proceedings



12. The SBI considered this matter at its 1st and 7th meetings, on 3 and 10 November, respectively. It had before it document FCCC/CP/1998/1 and Add.1.



13. Statements were made by the representatives of nine Parties, including one speaking on behalf of the European Community and its member States.



14. At the 1st meeting, on 3 November, the SBI agreed to consider this matter in the budget group established to consider the item on administrative and financial matters, chaired by Mr. Harald Dovland (Norway), Vice-President of the COP at its fourth session (see paragraph 65 below).



15. At the 7th meeting, the chairman of the budget group provided a report on the outcome of the group's deliberations.



 

2. Conclusions



16. At its 7th meeting, on 10 November, the SBI decided to forward to the COP plenary for further consideration a draft decision on the calendar of meetings of Convention bodies

2000-2001 prepared by the Chairman of the SBI (for the text of the draft decision, see FCCC/CP/1998/L.14).

 

B. National communications from Parties included in Annex I to the Convention

(Agenda item 4 (a) (i) of the Conference of the Parties)

 

1. Proceedings



17. The SBI considered this matter at its 4th and 7th meetings, on 4 and 10 November, respectively. It had before it the following documents: FCCC/CP/1998/4; FCCC/CP/1998/5; FCCC/CP/1998/11 and Add.1 and 2; FCCC/CP/1998/INF.9; and FCCC/CP/1998/MISC.8.

18. Statements were made by the representatives of 17 Parties, including one speaking on behalf of the Group of 77 and China, and another speaking on behalf of the European Community and its member States.



19. At its 4th meeting, on 4 November, the SBI agreed to consider this matter by way of a contact group, co-chaired by Mr. Mohamed Ould El Ghaouth (Mauritania) and Mr. Alexander Metalnikov (Russian Federation).



20. At the 7th meeting, on 10 November, the co-Chairs of the contact group provided a report on the outcome of the group's deliberations.



2. Conclusions



21. At its 7th meeting, on 10 November, having considered a proposal made by the Chairman, the SBI adopted the following conclusions:



(a) The SBI invited the SBSTA to take into account the issues raised in FCCC/CP/1998/INF.9 on its ongoing methodological work on greenhouse gas inventories and on the guidelines for the preparation of national communications by Parties included in Annex I to the Convention (Annex I Parties). The SBI further invited the SBSTA to provide clear guidance to Annex I Parties on the reporting of revisions to previously submitted inventory data. The SBI further urged the SBSTA to forward any relevant conclusions to the SBI no later than at the eleventh session;

 

(b) The SBI noted the need for further efforts to improve completeness, consistency and comparability of data and information;

 

(c) The SBI invited Parties to submit, by 1 February 1999, their views on the scope of the third national communications, which should be included in the answers to the questionnaire, requested by the SBSTA at its eighth session;(2)



(d) The SBI began its discussion on how the future in-depth review process could be

conducted, reported and considered on the basis of document FCCC/CP/1998/4. The SBI further invited Parties to submit, by 1 March 1999, their views on the scope and the modalities of the review process for the third national communications, including in-depth reviews, in the context of the Kyoto Protocol. The SBI requested the secretariat to prepare, for consideration at its tenth session, a document containing suggestions for the future review process, taking into account the views of Parties and the relevant requirements of the Kyoto Protocol;



(e) The SBI took note of document FCCC/CP/1998/5 and requested the secretariat to prepare a report on data comparisons to enable Parties to reach a conclusion on the feasibility of data comparisons at the tenth session of the SBI. It requested the secretariat to evaluate, in that report, the feasibility of data comparisons, including the availability of information on gases, sectors and sources, and the level of disaggregation. The report should also include specific suggestions on further work related to data comparisons, including comparisons of activity data, emission estimates and emission factors. Further, the SBI requested identification and analysis of the utility of sources other than national communications or inventories and methods of their compilation. The secretariat was requested to estimate the related resource implications;



(f) The SBI recalled decision 6/CP.3(3) and requested the secretariat to provide a report on the information contained in national inventory submissions for the tenth session of the subsidiary bodies. The SBI also requested the secretariat to include the available projection data in that report;



(g) The SBI decided to forward to the COP plenary for further consideration a draft decision on national communications from Parties included in Annex I to the Convention prepared by the Chairman of the SBI (for the text of the draft decision, see FCCC/CP/1998/L.10).



 

C. Initial national communications from Parties not included

in Annex I to the Convention

(Agenda item 4 (a) (ii) of the Conference of the Parties)



1. Proceedings



22. The SBI considered this matter at its 4th and 7th meetings, on 4 and 10 November, respectively. It had before it documents FCCC/CP/1998/INF.2 and FCCC/CP/1998/MISC.4.



23. Statements were made by the representatives of 19 Parties, including one speaking on behalf of the European Community and its member States.



24. At the 4th meeting, on 4 November, an oral report was made by one of the co-Chairs of the workshop to assist Parties in their deliberations on a process for considering non-Annex I Party communications, held on 3 and 4 August 1998 in Kuala Lumpur, Malaysia.



25. At the same meeting, the SBI agreed to consider this matter by way of a contact group, co-chaired by Mr. Paul Maclons (South Africa) and Mr. Daniel Reifsnyder (United States of America).



26. At the 7th meeting, on 10 November, the co-Chairs of the contact group provided a report on the outcome of the group's deliberations.



 

2. Conclusions



27. At its 7th meeting, on 10 November, the SBI decided to forward to the COP plenary for further consideration a draft decision on initial national communications from Parties not included in Annex I to the Convention, prepared by the Chairman of the SBI (for the text of the draft decision, see FCCC/CP/1998/L.11).



D. Financial mechanism

(Agenda item 4 (b) of the Conference of the Parties)



1. Proceedings



28. The SBI considered this matter at its 5th and 7th meetings, on 4 and 10 November, respectively. It had before it the following documents: FCCC/CP/1998/12 and Add.1; FCCC/CP/1998/MISC.3 and Add.1 and 2; and FCCC/SBI/1998/MISC.4 and Add.1/Rev.1.



29. Statements were made by the representatives of 16 Parties, including one speaking on behalf of the Group of 77 and China, and another speaking on behalf of the European Community and its member States.



30. At the 5th meeting, on 4 November, the SBI agreed to consider this matter by way of a contact group, co-chaired by Mr. John Ashe (Antigua and Barbuda), Vice-President of the COP at its fourth session, and Mr. Daniel Reifsnyder (United States of America).



31. At the 7th meeting, on 10 November, the co-Chairs of the contact group provided a report on the outcome of the group's deliberations.



 

2. Conclusions



32. At its 7th meeting, on 10th November, the SBI decided to forward to the COP plenary for further consideration two draft decisions on the financial mechanism, prepared by the Chairman of the SBI (for the text of the draft decisions, see FCCC/CP/1998/L.15).



E. Second review of the adequacy of Article 4.2(a) and (b)

(Agenda item 4 (d) of the Conference of the Parties)

33. The SBI considered this matter at its 5th and 7th meetings, on 4 and 10 November, respectively. It had before it the following documents: FCCC/CP/1998/MISC.6 and Add.1, and

FCCC/CP/1998/MISC.6/Add.2/Rev.1 and Add.3.



34. Statements were made by the representatives of 13 Parties, including one speaking on behalf of the European Community and its member States, and another speaking on behalf of the Group of 77 and China. A statement was also made by the representative of a

non-governmental organization.



35. At the 5th meeting, on 4 November, the SBI agreed to consider this matter by way of a contact group, co-chaired by Ms. Jennifer Irish (Canada) and Ms. Margaret Mukahanana  (Zimbabwe).



36. At the 7th meeting, on 10 November, the co-Chairs of the contact group provided a report on the outcome of the group's deliberations.



 

2. Conclusions



37. At its 7th meeting, on 10 November, the SBI decided to forward to the COP plenary for further consideration a draft decision on the second review of the adequacy of Article 4.2(a) and (b), prepared by the Chairman of the SBI (for the text of the draft decision, see FCCC/CP/1998/L.12), as well as draft decisions prepared by the Group of 77 and China (see FCCC/CP/1998/MISC.6/Add.2/Rev.1), Australia, Austria, on behalf of the European Community and its member States, and the United States of America (see FCCC/CP/1998/MISC.6/Add.3).



F. Implementation of Article 4.8 and 4.9 of the Convention (decision 3/CP.3 and

Articles 2.3 and 3.14 of the Kyoto Protocol)

(Agenda item 4 (e) of the Conference of the Parties)

38. The SBI considered this matter at its 1st and 7th meetings, on 3 and 10 November, respectively. It had before it document FCCC/SBI/1998/6.



39. Statements were made by the representatives of 12 Parties, including one speaking on behalf of the European Community and its member States, and another speaking on behalf of the Group of 77 and China.



40. At the 1st meeting, on 3 November, the SBI agreed to consider this matter by way of a contact group, co-chaired by Mr. Bo Kjellén (Sweden) and Mr. Mohammad Reza Salamat (Iran).



41. At the 7th meeting, on 10 November, the co-Chairs of the contact group provided a report on the outcome of the group's deliberations.

G. Activities implemented jointly: review of progress

under the pilot phase (decision 5/CP.1)

43. The SBI considered this matter at its 3rd and 7th meetings, which were held jointly with the SBI, on 3 and 10 November, respectively. It had before it the following documents: FCCC/CP/1998/2, FCCC/CP/1998/INF.3 and FCCC/CP/1998/MISC.7 and Add.1-4.



44. Statements were made by the representatives of 37 Parties, including one speaking on behalf of the African Group, one speaking on behalf of the European Community and its member States and another speaking on behalf of the Group of 77 and China.

 

45. At the joint meeting on 3 November, the Chairmen of the SBI and the SBSTA invited Ms. Cornelia Quennet-Thielen (Germany) to assist them in conducting informal consultations on this matter.

46. At its 7th meeting, held jointly with the SBSTA on 10 November, the SBI decided to forward a draft decision to the COP for further consideration (see FCCC/CP/1998/CRP.2).



H. Review of information and possible decisions

under Article 4.2(f)

 

(Agenda item 4 (g) of the Conference of the Parties)



 

1. Proceedings



47. The SBI considered this matter at its 4th and 5th meetings, on 4 November. It had before it document FCCC/CP/1998/13.



48. Statements were made by the representatives of six Parties, including one speaking on behalf of the European Community and its member States. The representative of a State not party to the Convention also made a statement.



49. At the 4th meeting, the Chairman invited Mr. Luis Herrera Marcano (Venezuela) to assist him in conducting informal consultations on this matter.



50. At the same meeting, the representative of Turkey made available to Parties a copy of a report entitled "Turkey: National Report on Climate Change".



51. At the 5th meeting, Mr. Luis Herrera Marcano provided a report on the informal consultations he had conducted.



2. Conclusions



52. At its 5th meeting, on 4 November, having considered a proposal made by the Chairman on the basis of informal consultations, the SBI decided to recommend a draft decision on the review of information and possible decisions under Article 4.2 (f) for adoption by the COP at its fourth session (for the text of the draft decision, see FCCC/CP/1998/L.2).

(Agenda item 5 (a) (ii-iv) of the Conference of the Parties)

53. The SBI considered these matters at its 4th and 7th meetings, which were held jointly with the SBSTA, on 4 and 10 November, respectively. It had before it the following documents: FCCC/CP/1998/MISC.7 and Add.1-4.



54. Statements were made by representatives of 36 Parties, including one speaking on behalf of the African Group, one speaking on behalf of the Alliance of Small Island States, one speaking on behalf of the European Community and its member States and another speaking on behalf of the Group of 77 and China.



55. At the joint meeting on 4 November, the SBI and the SBSTA agreed to consider this issue by way of a joint contact group, co-chaired by Mr. Yvo de Boer (Netherlands) and

Mr. Gylvan Meira Filho (Brazil).



2. Conclusions



56. At its 7th meeting, held jointly with the SBSTA on 10 November, the SBI decided to forward a draft decision by the Chairmen of the subsidiary bodies and a draft proposal by the co-Chairs of the joint contact group on mechanisms to the COP for further consideration (see FCCC/CP/1998/CRP.3).



J. Matters related to decision 1/CP.3, paragraph 6: preparations for the

first session of the Conference of the Parties serving as the meeting

of the Parties to the Kyoto Protocol

 

(Agenda item 5 (b) of the Conference of the Parties)



1. Proceedings



57. The SBI considered this matter at its 6th and 7th meetings, held jointly with the SBSTA, on 5 and 10 November, respectively. It had before it document FCCC/CP/1998/3.



58. Statements were made by the representatives of 26 Parties, including one speaking on behalf of the European Community and its member States. The representatives of an observer State and two non-governmental organizations also made statements.



59. At the joint meeting on 6 November, the Chairmen of the SBI and the SBSTA invited Mr. Espen Ronneberg (Marshall Islands), Vice-President of the COP at its fourth session, to assist them in conducting informal consultations on this matter.



2. Conclusions



60. At its 7th meeting, held jointly with the SBSTA on 10 November, the SBI decided to forward an informal proposal by the Chairmen of the subsidiary bodies to the COP for further consideration (see FCCC/CP/1998/CRP.4).



K. Administrative and financial matters

(Agenda item 6 of the Conference of the Parties)

61. The SBI considered this matter at its 1st and 7th meetings, on 3 and 10 November, respectively. It had before it documents FCCC/CP/1998/8 and Add.1, FCCC/CP/1998/9, FCCC/CP/1998/10, FCCC/CP/1998/INF.1, FCCC/CP/1998/INF.6.



62. Statements were made by the representatives of 10 Parties, including one speaking on behalf of the European Community and its member States, and another speaking on behalf of the Group of 77 and China.



63. At the 1st meeting, on 3 November, the SBI agreed to consider this matter by way of a budget group, chaired by Mr. Harald Dovland (Norway), Vice-President of the COP at its fourth session.



64. At the 7th meeting, on 10 November, the Chairman of the budget group provided a report on the outcome of the group's deliberations.

2. Conclusions



65. At its 7th meeting, on 10 November, having considered a proposal made by the Chairman on the basis of informal consultations, the SBI decided to recommend a draft decision on administrative and financial matters for adoption by the COP at its fourth session (for the text of the draft decision, see FCCC/CP/1998/L.13).



IV. ADOPTION OF THE REPORT

(Agenda item 4)



66. The SBI considered the item on the report on the session at its 7th meeting, on

10 November. At that meeting, the SBI considered the draft report on its ninth session (FCCC/SBI/1998/L.2).



67. Also at that meeting, the SBI requested the Chairman to prepare the report, with the assistance of the secretariat, taking into account the discussions and the conclusions reached during the session, as well as the need for editorial adjustments.



68. The representative of one Party, speaking on behalf of the Asian Group, noted that the Group had continued to demonstrate flexibility with regard to the issue of election of officers.



 

V. CLOSURE OF THE SESSION



69. At the 8th meeting, after thanking all participants for their constructive cooperation, and having thanked the Government of the Republic of Argentina for hosting the ninth session of the SBI, the Chairman declared the session closed.
