Item 2 (a) of the provisional agenda
1. Arrangements have been made for the eighth session of the
Subsidiary Body for Implementation (SBI) to be held at the Hotel
Maritim, Bonn, from 2 to 12 June 1998. The session is scheduled to be
opened by the Chairman at 10 a.m. on Tuesday, 2 June
1998.
2. Parties should be aware that this session of the SBI will
differ from earlier sessions in that more time will be available for
discussions, which will facilitate substantive negotiations by
Parties. As time will be limited at its ninth session, the SBI should
aim to arrive at conclusions on many of the issues before it at its
eighth session.
3. The provisional agenda for the eighth session of the SBI, proposed after consultation with the Chairman, is as follows:
1. Opening of the session.
2. Organizational matters:
(a) Adoption of the agenda;
(b) Election of officers other than the Chairman;

4. The eighth session of the SBI is scheduled to be opened by the
Chairman at 10 a.m. on Tuesday, 2 June 1998.
(a) Adoption of the agenda
5. The provisional agenda for the eighth session of the SBI is
presented for adoption (see paragraph 3 above).
6. Sub-items 8 (b) to (d) of the provisional agenda are among the issues arising from decision 1/CP.3, paragraph 5.(2) The Chairmen of the SBI and the Subsidiary Body for Scientific and Technological Advice (SBSTA) were requested to "give guidance to the secretariat on the preparatory work needed for consideration by the Conference of the Parties, at its fourth session" in relation to the issues listed in that paragraph and "to allocate work thereon to the respective subsidiary bodies, as appropriate". Following discussions between the Chairmen,
sub-items 8 (b) to (d) have been placed on the
provisional agendas of both bodies.
7. The Chairmen of the SBI and the SBSTA are holding informal
consultations on the organization of work on the above-mentioned
sub-items with a view to seeking an appropriate balance and avoiding
duplication and overlap. Based on these consultations, a joint
proposal will be made, and reproduced in document
FCCC/SB/1998/3.
(b) Election of officers other than the
Chairman
8. At its third session, the Conference of the Parties (COP 3)
elected by acclamation the Chairman of the SBI. The COP agreed that
consultations should continue with regard to nominations for the
posts of vice-chairman and rapporteur with a view to their election
at the eighth session of the SBI (see FCCC/CP/1997/7). Early
agreement on these nominations will enable the SBI to commence its
substantive work in an efficient manner and permit the Chairman to
share the responsibility of leadership.
(c) Organization of the work of the
session
(i) Arrangements on sub-items 8 (b) to 8 (d) of the provisional
agenda
9. The Chairmen of the SBSTA and the SBI will put forward an
approach, in their joint proposal mentioned in paragraph 7 above,
concerning the organization of work on issues arising from decision
1/CP.3, paragraph 5. This approach may include such arrangements as
joint meetings or the participation of the Vice-Chairman from one
body in the meetings of the other.
(ii) Documentation
10. The provisional agenda has been drawn up taking account of the
expected timely availability of documentation in the six languages of
the United Nations. A list of documents relating to the provisional
agenda, as well as other documents available at the session, is
contained in the annex below.
(iii) Schedule
11. The scheduling of meetings for the session will be based on
the availability of facilities during normal working hours when
services are available for two meetings of Convention bodies with
interpretation from 10 a.m. to 1 p.m. and from 3 p.m. to 6 p.m. There
will also be some facilities for informal meetings without
interpretation. Delegations are urged to use these facilities fully
by attending all meetings promptly at the scheduled time. A schedule
of meetings will be proposed after further consultations by the
Chairmen on the organization of work and will be contained in the
document mentioned in paragraph 7 above.
(d) Allocation of work - issues arising from decision
1/CP.3, paragraph 6
12. In decision 1/CP.3, paragraph 6, the COP invited the Chairmen
of the SBSTA and the SBI "to make a joint proposal to those bodies,
at their eighth sessions, on the allocation to them of preparatory
work to enable the Conference of the Parties serving as the meeting
of the Parties to the Protocol, at its first session after the entry
into force of the Protocol, to accomplish the tasks assigned to it by
the Protocol".
13. The joint proposal put forward by the Chairmen of the SBI and
the SBSTA in response to the above-mentioned mandate is contained in
document FCCC/SB/1998/1. Parties are invited to consider this joint
proposal with a view to recommending, at the eighth sessions of the
two subsidiary bodies, its adoption by the COP at its fourth session.
Consideration of this matter could be expedited by way of a joint
contact group. The Chairmen may make further proposals in this
regard.
(e) Organization of the work of future
sessions
14. Having confirmed the allocation of preparatory work to the
subsidiary bodies and using document FCCC/SB/1998/1 as a basis for
discussion, Parties may also wish to address the programme of work
necessary for the SBI to prepare for the first session of the
Conference of the Parties serving as the meeting of the Parties
(COP/MOP 1) with a view to taking a decision, at its eighth session,
which will enable substantive work to begin at the ninth session of
the SBI. In particular, the SBI may wish to identify any priority
areas for consideration and review how the tasks to be accomplished
by COP/MOP 1 could best be integrated into the existing work
programme. Parties may also wish to request any inputs from the
secretariat which could assist in their deliberations. Consideration
of the programme of work for COP/MOP 1 could also be dealt with in
the joint contact group referred to in paragraph 13
above.
(a) Communications from Parties included in Annex I to
the Convention
15. At its second session, by its decision
9/CP.2,(3) the COP requested Annex I
Parties to submit to the secretariat, in accordance with Article 12.1
and 12.2 of the Convention, a second national communication by 15
April 1997. It also decided that the second national communications
from Parties with economies in transition should, in principle, be
submitted no later than 15 April 1998. Annex I Parties were also
requested to submit to the secretariat national inventory data on
emissions by sources and removals by sinks, on an annual basis, by
15 April of each year, following the principles contained in
decision 3/CP.1.(4) The SBI may wish
to take note of the list of submissions so far, and urge those Annex
I Parties whose second national communications or annual national
greenhouse gas (GHG) inventories are overdue, to submit them as soon
as possible and, to the extent possible, provide submissions in
electronic format.
16. The SBI, at its seventh session, took note of the first
compilation and synthesis of second national communications
(FCCC/SBI/1997/19 and Add.1) prepared by the secretariat. The COP, at
its third session, by its decision 6/CP.3, requested the secretariat
to prepare a full compilation and synthesis of second national
communications from Annex I Parties for consideration at its fourth
session and, in those years when a compilation and synthesis is not
prepared, to prepare a report on national greenhouse gas inventories
submitted annually by Parties. The secretariat proposes to update the
compilation and synthesis on the basis of national communications
received by 30 June 1998 and to provide a report, in
English only, on national greenhouse gas inventories of any inventory
data submitted by 30 September 1998. The secretariat also
proposes, on the basis of inventory data submitted by
30 September, to make available each Party's annual emission
inventories on the secretariat's Web site, as requested by the SBI at
its seventh session. The SBI may wish to take note of the above and
urge Parties to provide their submissions in accordance with the
agreed schedule.
17. The SBI, at its seventh session, requested the secretariat to
evaluate the feasibility of compiling and maintaining available
supplementary data from authoritative sources on GHG emissions for
the purpose of comparison with national submissions and to present a
report on this comparison to the SBI at its ninth session. The
secretariat intends to prepare a report for that session on the
feasibility of compiling and maintaining such data and report on the
comparison of such data, to the extent possible, taking into account
any methodological work requested by SBSTA, in particular the
comparison of GHG inventories obtained using best methodologies and
those using current Intergovernmental Panel on Climate Change (IPCC)
default methodologies.
18. The secretariat has finished in-depth reviews of first
national communications from Annex I Parties submitted between 1994
and 1997 and embarked on in-depth reviews of second national
communications from these Parties. The SBI may wish to take stock of
the first round of reviews based on the in-depth review reports of
first national communications published so far. An information
document (FCCC/SBI/1998/INF.1) contains information on the status of
publication of first in-depth review reports, status of submission of
second national communications, as well as the schedule for in-depth
review visits for 1998.
19. The SBI will also have for its information the list of
government-nominated experts for participation in the in-depth
reviews (FCCC/SBI/1998/INF.2). As only a limited number of Parties
have sent to the secretariat their corrections to the list made
available at the seventh session of the SBI (FCCC/SBI/1997/CRP.7) or
submitted new nominations, the SBI may wish to urge Parties to do so,
to enable the secretariat to broaden its sources of national
expertise.
(b) Communications from Parties not included in Annex I
to the Convention
(i) Provision of financial and technical support, including secretariat's observations
on initial national communications
20. At its second session, by its decision 10/CP.2, paragraph 1
(a), the COP requested the secretariat, in accordance with Article
8.2(c), to facilitate assistance to Parties, particularly developing
country Parties, in the preparation of their initial communications
and to provide a report to the SBI and the SBSTA at each of their
sessions. The progress report of the secretariat on these issues will
be contained in document FCCC/SBI/1998/INF.3. As requested by the SBI
at its seventh session, the progress report will also include the
secretariat's observations on the initial communications submitted by
non-Annex I Parties by 30 March 1998. An update to the
information on the indicated dates of submission of the initial
national communications of non-Annex I Parties, which was presented
to the SBI at its seventh session (FCCC/SBI/1997/INF.3), will be
contained in document FCCC/SBI/1998/INF.3/Add.1.
(ii) Information on relevant action by the Council of the
Global Environment Facility (GEF)
21. At its second session, by its decision 10/CP.2, paragraph 1
(b), the COP requested the secretariat to make available to the SBI,
at each of its sessions, details of the financial support provided by
the GEF to non-Annex I Parties for the preparation of their initial
communications. This information will be contained in document
FCCC/SBI/1998/MISC.1.
(iii) Process for considering non-Annex I Party
communications
22. At its seventh session, the SBI took note of the views
expressed by Parties and the text of the Co-chairs' draft compilation
on the process for consideration of communications from Parties not
included in Annex I to the Convention. It invited Parties to submit
comments on the Co-chairs' draft compilation by 21 March 1998, and
requested the secretariat to make them available to the SBI in order
to facilitate its work in recommending a decision to the Conference
of the Parties at its fourth session. Any submissions received will
be made available in a miscellaneous document
(FCCC/SBI/1998/MISC.2).
23. At the same session, the SBI also requested the secretariat to
organise a workshop, prior to the eighth session of the SBI, with the
aim of assisting deliberations on the matter in the light of
submissions of initial communications received by the secretariat by
that time. A report will be presented to the SBI by the Co-chairs of
the workshop.
(a) Review process referred to in decision
9/CP.1
24. The SBI, at its fifth session, acting upon a request by the
COP at its second session (decision 11/CP.2), began to undertake the
review process of the financial mechanism referred to in decision
9/CP.1 on the basis of guidelines contained in document
FCCC/SBI/1997/6, paragraph 20, and with a view to reporting on the
outcome to the COP at its third session. The review process continued
throughout the sixth and seventh sessions of the SBI.
25. The COP, at its third session, reaffirmed its decision 9/CP.1,
decided to continue the review process through the SBI in accordance
with the criteria established in the guidelines above and requested
the secretariat to report to the SBI accordingly.
26. The report of the GEF Monitoring and Evaluation Programme will be made available to the eighth session of the SBI (see document FCCC/SBI/1998/MISC.1).
(b) Guidance to the Global Environment
Facility
27. The guidance provided so far by the COP to the GEF, as the interim operating entity of the financial mechanism of the Convention, is contained in decisions 11/CP.1 and 11/CP.2. In addition, the guidelines for the preparation of initial national communications from non-Annex I Parties are to serve as policy guidance to the GEF for the provision of support needed by these Parties to meet their obligations under Article 12.1 of the Convention (see annex to
decision 10/CP.2).
28. As guidance to the GEF is to be formulated as needs arise, the
SBI may wish to keep this item on its agenda and consider, from time
to time, whether any further guidance is needed. At this stage, the
SBI may take into account any relevant conclusions of the SBSTA with
respect to technology information centres and education and public
awareness, and any remaining issues regarding the dissemination of
initial national communications from non-Annex I Parties, as
described in document FCCC/SBI/1998/INF.3, as well as the report of
the Monitoring and Evaluation Programme of the GEF.
29. In accordance with Article 4.2(d) of the Convention, a second
review of Article 4, subparagraphs 2 (a) and (b) shall take place not
later than 31 December 1998.
30. The Conference of the Parties, at its third session, decided to place the issue of
the second review of the adequacy of Article 4.2(a) and (b) on the
agenda for its fourth session, and requested the subsidiary bodies
and the secretariat to make all necessary preparations to facilitate
future consideration of that item (see FCCC/CP/1997/7, para.
63).
31. The SBI may wish to consider action in response to the request
of the COP. The SBI will have before it a note by the secretariat
(FCCC/SBI/1998/2) on possible elements of the second
review.
subparagraph 2 (f) of the
Convention
32. Article 4.2(f) of the Convention provides that "the Conference
of the Parties shall review, not later than 31 December 1998,
available information with a view to taking decisions regarding such
amendments to the lists in Annexes I and II as may be appropriate,
with the approval of the Party concerned".
33. At its third session, the COP reviewed the lists in Annexes I and II and adopted
decision 4/CP.3 by which it decided to delete the name of
Czechoslovakia and include the names of Croatia, the Czech Republic,
Liechtenstein, Monaco, Slovakia and Slovenia in Annex I to the
Convention. The Conference also received and considered a request
from Turkey (contained in document FCCC/CP/1997/MISC.3) to delete its
name from the lists in Annexes I and II but could not reach a
consensus regarding that request.
34. At the same session, the COP requested the SBI, at its eighth
session, to consider the request from Turkey and to submit a report
to the COP at its fourth session for consideration and definitive
action (FCCC/CP/1997/7, para. 68). The SBI is invited to consider the
request from Turkey taking into account document FCCC/CP/1997/MISC.3
and submit its report to COP 4. This report could take the form of a
recommendation or draft decision. The SBI may also wish to undertake
another review of the lists in Annexes I and II of the Convention on
the basis of available information and make a recommendation to COP
4.
35. By its decision 3/CP.3, the COP requested the SBI at its
eighth session to undertake a process to identify and determine
actions necessary to meet the specific needs of developing country
Parties arising from the adverse effects of climate change and/or the
impact of the implementation of response measures. The decision
indicated that issues for consideration "shall include actions
related to funding, insurance and transfer of technology". The COP
further requested the SBI to report to COP 4 on the outcome of this
process. Based on the conclusions and recommendations of this
process, COP 4 is invited to take a decision on the actions. The SBI
may wish to consider how this process should be undertaken with a
view to making a recommendation to COP 4.
36. The Parties may wish to consider in an integrated manner, in the SBSTA and the SBI, further work on activities implemented jointly (AIJ) under the pilot phase (agenda item 8 (a)) and the preparatory work needed for action by COP 4 on the mechanisms for cooperative implementation established by the Kyoto Protocol, as mandated by decision 1/CP.3, paragraphs 5 (b), (c) and (e) (agenda items 8 (d), 8 (b) and 8 (c) respectively). These three mechanisms, established by the Protocol, are addressed in Articles 6 (joint implementation (JI)), 12 (clean development mechanism (CDM)) and 17 (emissions trading) of the Protocol, and are also referred to in its Article 3, paragraphs 10 and 11 (JI and emissions trading) and paragraph 12 (CDM). A coordinated approach to work on all four mechanisms by the SBSTA and the SBI will be proposed by the Chairmen of these bodies after consultations and will be contained in document FCCC/SB/1998/3.
37. The Chairmen will also suggest an approach to preparatory work on the CDM that goes beyond the limited mandate contained in decision 1/CP.3, paragraph 5 (e). That mandate refers only to Article 12, paragraph 10, concerning the use of certified emission reductions between 2000 and the start of the first commitment period. It may be assumed that preparatory work on other aspects of Article 12 will be required.
38. In support of their consideration of these matters, the Parties will have before them three documents:
(a) An update on AIJ under the pilot phase (FCCC/SBSTA/1998/INF.3);
(b) A compilation of submissions by Parties on preparatory work
needed for COP 4 on the items listed in paragraph 5 of decision
1/CP.3 (FCCC/SB/1998/MISC.1); and
(c) A note by the secretariat on issues related to the three
mechanisms for cooperative implementation established by the
Protocol. This document (FCCC/SB/1998/2) also deals with linkages
between these mechanisms and AIJ.
39. Parties may wish to take note of the information and views
contained in the documents, review proposed preparatory work needed
for the consideration of the relevant issues by COP 4, give guidance
to the secretariat on further work and take other decisions that will
lay the ground for action by COP 4.
40. In the light of the mechanisms provided for by Articles 6, 12
and 17 of the Kyoto Protocol, the Parties may wish to determine which
elements of work under the AIJ pilot phase could contribute to their
functioning. Parties may also wish to initiate preparations for a
possible decision to be taken at COP 4 on the AIJ pilot phase, in
accordance with decision 5/CP.1.
(a) Arrangements for COP 4
41. By its decision 5/CP.3, the COP accepted with gratitude the
generous offer of the Government of Argentina to host COP 4 and
decided that the fourth session should be held in Buenos Aires,
Argentina, from 2 to 13 November 1998. The COP requested the
Executive Secretary to conclude a host country agreement with the
Government of Argentina on arrangements for the fourth session of the
Conference of the Parties.
42. The SBI will have before it document FCCC/SBI/1998/3
containing information on arrangements being made by the secretariat
in connection with COP 4, a list of possible elements for a
provisional agenda for the session and suggestions concerning the
organization of the work of the session, including the organization
of a high-level segment. The SBI may wish to take note of the
information received and give guidance on these and any other matters
it considers necessary to facilitate the preparations for COP
4.
(b) Calendar of meetings
43. At its third session, the COP adopted the calendar of meetings
of Convention bodies for 1998-1999 (FCCC/CP/1997/7, para. 35). The
SBI may wish to turn its attention to planning the calendar of
meetings for the period 2000-2001. This would enable the secretariat
to make the necessary arrangements. The SBI is also invited to
consider the implications of decision 52/445 of 18 December 1997,
"Progress in the implementation of conventions relating to
sustainable development", adopted by the United Nations General
Assembly at its fifty-second session. This decision invites
"beginning in the year 2000, the conferences of the parties to the
conventions signed at the United Nations Conference on Environment
and Development or established as a result of the Conference, as well
as other conventions relating to sustainable development, to take all
appropriate measures to avoid convening their sessions and those of
their subsidiary bodies during the sessions of the General Assembly".
The SBI will have before it document FCCC/SBI/1998/3.
(c) Date and venue of COP 5
44. Article 7, paragraph 4 of the Convention provides that
ordinary sessions of the COP shall be held every year unless
otherwise decided by the Conference of the Parties. Consequently, the
fifth session of the COP should take place in 1999. A sessional
period is currently scheduled for 25 October - 5 November. There are
a number of issues that must be addressed by the COP before the end
of 1999, such as the programme budget for the biennium 1999-2000 and
the review of the institutional linkage of the Convention and the
secretariat to the United Nations.
45. A decision on the date and venue of COP 5 must be taken at COP 4. In the context of the traditional rotation of the presidency among the five regional groups, it will be the turn of a member of the Group of Eastern European States to hold that post. Interested Parties are invited to submit offers to host COP 5 by the June meetings of the subsidiary bodies, so that preparations can be made for COP 4 to take the necessary decision in that regard.
(d) Volume of documentation
46. By its decision 18/CP.3, the COP requested the Executive
Secretary to explore with the United Nations the possibility of
ensuring unrestricted access to all language versions of the
documents of the United Nations Framework Convention on Climate
Change that the United Nations makes available on its optical
disk system through a restricted page on the World Wide Web. The
results of these discussions are ongoing. The secretariat will report
orally to the SBI when the agenda item is taken up.
(a) Programme budget for the biennium
1998-1999
47. At its third session, by its decision 15/CP.3, the COP
requested the Executive Secretary to report to the SBI at its eighth
session on: (a) the implementation of the conference services
contingency budget and (b) the deployment of staff and financial
resources to perform the tasks arising from the adoption of the Kyoto
Protocol. Document FCCC/SBI/1998/4 contains information regarding the
deployment of posts and financial resources among subprogrammes and
objects of expenditure taking into consideration the programme of
work and additional tasks arising from the adoption of the Kyoto
Protocol. It also provides a brief report on the payment of 1998
contributions. The SBI is invited to take note and approve of the
deployment and reallocation of resources and to urge Parties to pay
contributions on time and in full.
(b) Financial performance in the biennium
1996-1997
48. By its decision 16/CP.3, the COP requested the Executive
Secretary to take the necessary steps to establish a new trust fund
for the special annual contribution by the Government of Germany. By
paragraph 4 of that decision, COP 3 requested the Executive Secretary
to submit to the COP at its fourth session, through the SBI, a final
report on financial performance in 1996-1997, including an audited
financial statement. In document FCCC/SBI/1998/4, the Executive
Secretary reports on the establishment of the new trust fund and on
the contributions made for the biennium to all three UNFCCC trust
funds. As the report on final expenditures in the biennium had not
been received from the United Nations Office at Geneva at the
time of preparation of this report, and as the audited financial
statements will not be available from the United Nations Board of
Auditors until mid-1998, it is recommended that consideration of
these items be deferred until the next session. The SBI may wish to
take note of the establishment of the new trust fund and to endorse
the Executive Secretary's suggestion to report on the actual
expenditures to COP 4 through the ninth session of the
SBI.
(c) Financial procedures
49. By its resolution 52/215, the General Assembly revised the
United Nations scale of assessment, reducing the scale for most
of the least developed countries from 0.01 per cent to 0.001 per
cent. Considering that the contributions to the core budget are based
on the United Nations scale, and in view of the fact that the
financial procedures of the Convention stipulate that no Party should
contribute less than 0.01 per cent, the SBI is invited to
consider three scenarios proposed in document FCCC/SBI/1998/4 and
recommend to the Conference of the Parties, for approval at its
fourth session, the procedure to be used in determining the
indicative scale of contributions to the
core budget.
(d) Administrative
arrangements
50. The Executive Secretary will report at the session on his
discussions with the United Nations on the review of administrative
arrangements and the use of overhead resources.
51. During 1997, the secretariat prepared two papers for the sixth
session of the SBI on this agenda item (FCCC/SBI/1997/14 and
FCCC/SBI/1997/14/Add.1), and compiled views of governments and
non-governmental organizations (NGOs) in a further paper
(FCCC/SBI/1997/MISC.7) for the seventh session. The Chairman of the
SBI at its seventh session proposed the formation of a contact group
to formulate conclusions and recommendations. Given the shortage of
time, it was not possible for the group to meet. Consequently, the
SBI concluded that it would consider this agenda item at its eighth
session.
52. At its seventh session, the SBI also requested the secretariat to advise the SBI on the elements in other United Nations procedures that could be relevant to the development of procedures for the participation of non-governmental organizations in the Convention process.
A selection of such relevant procedures will be available to the
SBI in document FCCC/SBI/1998/5.
53. It is hoped that, based on the previous papers submitted as
well as the additional paper now available, the SBI will finalize its
consideration of this item and prepare relevant conclusions and
recommendations.
54. Because of the time that is likely to be needed for
considering all the items on the agenda, a complete draft text of the
report may not be available at the end of the session. The SBI may
wish to adopt decisions or substantive conclusions, and authorize the
