PROVISIONAL AGENDA AND ANNOTATIONS


Note by the Executive Secretary

I. INTRODUCTION


1. Arrangements have been made for the eighth session of the Ad Hoc Group on the Berlin Mandate (AGBM) to be held at the Beethovenhalle, Bonn, from 22 to 31 October 1997. The session will be opened by the Chairman at 10.00 a.m. on Wednesday, 22 October 1997.



II. PROVISIONAL AGENDA

2. The provisional agenda for the eighth session of the AGBM, proposed after consultation with the Chairman, is as follows:

2. Organizational matters:

 

(a) Adoption of the agenda;

(b) Organization of the work of the session.

 

3. Completion of a protocol or another legal instrument.

4. Report to the third session of the Conference of the Parties and related matters.

5. Report on the session.

III. ANNOTATIONS TO THE PROVISIONAL AGENDA

 

1. Opening of the session


3. The eighth session of the Ad Hoc Group on the Berlin Mandate (AGBM) will be opened by the Chairman at 10.00 a.m. on Wednesday, 22 October 1997.

2. Organizational matters


(a) Adoption of the agenda

4. The provisional agenda for the eighth session of the AGBM is presented for adoption

(see paragraph 2 above). The provisional agenda is focussed on the need to move the negotiations forward so that the terms of the Berlin Mandate can be successfully completed by the third session of the Conference of the Parties (COP 3).

(b) Organization of the work of the session

(i) Documentation

5. A list of documents relating to the provisional agenda, as well as other documents available at the session, is contained in annex I to this document.

6. The main document for the eighth session will be the consolidated negotiating

text by the Chairman (FCCC/AGBM/1997/7). It will be supplemented by the reports by the Chairmen of the informal consultations held at the seventh session (FCCC/AGBM/1997/INF.1), and the negotiating text by the Chairman (FCCC/AGBM/1997/3/Add.1). The proposals on which these documents are based are contained in documents FCCC/AGBM/1996/MISC.2 and Add.1-4 and FCCC/AGBM/1997/MISC.1 and Add.1-5. Additional proposals received after the seventh session will be issued in a miscellaneous document.

(ii) Schedule

7. The scheduling of meetings for the session will be based on the availability of facilities during normal working hours, when services are available for two meetings with interpretation from 10 a.m. to 1 p.m. and from 3 p.m. to 6 p.m. There will also be some facilities for informal meetings without interpretation. Delegations are urged to use these facilities fully by starting all meetings promptly at the scheduled time. A suggested approach to the organization of work is contained in annex II below. Delegations may wish to note that meetings with interpretation have been scheduled for Saturday, 25 October 1997.

8. As has been the practice in the two previous sessions, the Chairman will continue to use informal consultations ("non-groups") as vehicles to advance negotiations on the various elements of the text.

3. Completion of a protocol or another legal instrument


9. The consolidated negotiating text prepared by the Chairman and contained in document FCCC/AGBM/1997/7 will help focus the work of the eighth session and provide the basis for the completion of the protocol or another legal instrument. The consolidated negotiating text is derived from the work of the AGBM at its seventh session and from informal consultations held during the inter-sessional period. Parties are invited to continue negotiations on the consolidated negotiating text with the view to reaching agreement on all issues.

10. The reports by the Chairmen of the informal consultations presented to the AGBM at the end of the seventh session are available in document FCCC/AGBM/1997/INF.1. These reports contain texts which are indicative of the status of negotiations in the informal consultations. In addition, the negotiating text by the Chairman and relevant proposals are still before the Group.

4. Report to the third session of the Conference of the Parties

and related matters


11. In accordance with decision 1/CP.1 of the first session of the Conference of the Parties (COP 1) on the Berlin Mandate, the AGBM will complete its work on a protocol or another legal instrument at the eighth session and transmit the results to the COP at its third session for finalization and subsequent adoption. The AGBM may also wish to consider the contents of the report which the Chairman of the AGBM will give to the COP at its third session, and any related matters.

5. Report on the session


12. The main result of the session must be agreement on the final text of a protocol or another legal instrument. This text will be transmitted to the COP at its third session.

13. A draft report on the work of the session will be prepared for consideration by the AGBM at the session. The AGBM is invited to authorize the Rapporteur to complete the report after the session, under the guidance of the Chairman and with the assistance of the secretariat.
